Charlotte County approves participation in Kroger opioid settlement under Virginia MOU

The Charlotte County Board of Supervisors voted July 10 to participate in a nationwide opioid settlement with Kroger and its related corporate entities and directed the County Attorney and the County’s outside counsel to execute the necessary documents.
Administrator Daniel Witt reminded the Board that Charlotte County has participated in prior opioid settlements and that proceeds are restricted to opioid abatement purposes consistent with the Virginia Opioid Abatement Fund and Settlement Allocation Memorandum of Understanding (the "Virginia MOU"). Witt said the county’s outside opioid litigation counsel recommended participation and that the County Attorney concurred. He also said there are no financial obligations to the county from participating.
Supervisor Noah Davis asked whether the County had received any direct benefits from previous settlements; Administrator Witt said the County is receiving funds from prior settlements that must be used for specific purposes related to drug use and abuse and that he has asked the Opioid Council whether funds can be used for the county’s Drug Box program, a determination that is still pending.
Supervisor Hazel Bowman Smith made the motion to adopt the Kroger Resolution, seconded by Supervisor Noah Davis. Administrator Witt requested a roll‑call vote. Supervisors Gary D. Walker, Hazel Bowman Smith, Noah Davis, Robert L. Shook Jr., Henry Carwile and Derek Toombs voted yea; Vice Chairman Walter T. Bailey was absent. The resolution passed and the county’s counsel was authorized to execute settlement documents and the required release of claims against Kroger.
The resolution text incorporated the Virginia MOU and stated the county’s share of any recovery would be administered under the MOU in the same manner as prior settlements.
