County discloses pending lawsuit during executive session, reconvenes without votes

The Cusseta–Chattahoochee County commission voted unanimously on Oct. 1 to enter executive session at 6:57 p.m. to discuss personnel and legal matters, then reconvened at 7:44 p.m.
County Attorney Bin Minter told the board there are two pending legal matters on file in Superior Court involving the county: one is an appeal from Magistrate Court, Case 23-CV-0257; the other is a separate lawsuit discussed in executive session. Earlier in the meeting minutes the attorney referenced a public-record lawsuit described in the meeting packet as a $5 million matter; the attorney said further details would be discussed in executive session and are public record but would be addressed there.
Chairman Charles Coffey confirmed the topics discussed during the closed meeting fell within the legal exceptions to Georgia’s open-meetings law and that no votes were taken in executive session.
The meeting minutes record the executive-session start and reconvening times and an affidavit of attending members documenting the closed portion and its legal basis under O.C.G.A. § 50-14-2 and § 50-14-3.
