Josephine County commissioners disagree over who can fill vacant seat after 30-day window

Acting Chair Chris Barnett and Commissioner Ron Smith debated who has authority to appoint a replacement to the vacant Commissioner Position 1 during a Josephine County Board of Commissioners workshop on Jan. 7, 2026.

The dispute centers on the county charter’s 30-day requirement for filling vacancies and how recusal and quorum rules affect appointment authority. Legal counsel Wally Hicks told the board he interprets the explanatory statement to mean appointment authority may have transferred to a temporary board after the 30-day period lapsed. Hicks said he intends to coordinate a meeting of that temporary board, composed of other elected county officers, to determine next steps.

Barnett framed her remarks around duty and continuity. "I have an obligation to fulfill the duties of office and uphold my oath to perform the responsibilities of Commissioner," she said. Commissioner Smith emphasized the role of discretionary authority for elected officials and raised concerns about how recusal and quorum interpretation could affect the process.

Board members discussed technical questions including whether appointment authority automatically transfers after 30 days, whether a temporary board can act in place of the regular board, and how ballot-measure explanatory language should be read in that context. No formal appointment was made at the workshop.

Next steps: Hicks will coordinate the temporary board meeting to seek a procedural path forward. The board did not adopt a definitive timeline at the workshop.
