City Attorney Elliott told the board on Jan. 19 that the city's long‑term contract with Digital Ally for cameras and recording equipment had been troubled by malfunctions and missed obligations. Elliott said the city withheld a final payment of about $40,000 while seeking remediation and that he negotiated a mutual release and settlement for $20,000 and return of a backup hard drive.
Elliott said pursuing litigation would likely require suits in Kansas and would not be the best use of city resources, and he recommended acceptance of the settlement. The commission voted unanimously to approve the mutual release and settlement.
City Manager Johnson said some cameras had worked while others had not and characterized the settlement as the simplest way to end the dispute without out‑of‑state litigation. The City Attorney's Office will finalize paperwork and receive the backup drive as part of closing the agreement.
