Mercer County adopts updated flood ordinance and approves multiple contracts, budget amendments

STANTON, N.D. — The Mercer County Commission on Feb. 6 adopted an updated floodplain ordinance and approved a bundle of contracts, budget amendments and routine business during a meeting at the Mercer County Government Center.
Chairman Gene Wolf opened the meeting at 9 a.m.; Commissioners Jamee Folk, Mark Pierce, Rick Bauman and Casey Voigt were recorded as present. Tax Director Jen Neumiller presented the ordinance on its second reading and, after a motion by Commissioner Jamee Folk and a second from Commissioner Mark Pierce, the five commissioners present voted to adopt the updated flood ordinance.
The vote followed a public hearing during which no public comments were received. The ordinance replaces the county’s existing flood rules as presented at the hearing; the document was described in the meeting as an updated flood ordinance and adopted on second reading.
The board approved multiple administrative actions in the same session. Commissioners approved an agreement with Donovan & Kaffar, PLLP to update and rewrite Mercer County’s planning and zoning ordinances. Commissioner Folk moved to approve the contract and the motion passed unanimously.
Commissioners also approved a set of 2024 budget amendments addressing several departmental overages and fund shortfalls. The minutes list major overrun items including a Landfill fund shortfall of $75,214.62 tied to unforeseen capping project expenses and a health insurance overrun of $60,004.49; several other line-item adjustments across general fund accounts were approved. Commissioner Mark Pierce moved to approve the 2024 amendments and the motion carried.
The board approved a Tyler Technologies software amendment presented by States Attorney Todd Schwarz and an Energy Tech System services contract for building maintenance with a voucher of $17,475.00. Commissioners approved the Hazen Golf Course liquor license application and authorized an overhead door replacement at the county landfill after Landfill Director Candi Strand requested the purchase.
Human Resources/EM Director Alice Grinsteinner presented a new North Dakota PERS defined contribution retirement option for employees who have never been on a PERS plan; the county will pay the base employer share of 9.26 percent and will match an employee’s optional additional 3 percent contribution if chosen (a 15.26 percent maximum total). Commissioner Casey Voigt moved to adopt the plan and the motion passed unanimously.
The board also approved a limited bereavement accommodation that allows scheduled employees to attend a coworker’s funeral without using vacation leave. Commissioners approved the State Auditor’s letter of understanding for the 2023 audit and other routine vouchers and minutes as part of the meeting’s consent items.
The commission recessed briefly midmeeting and later appointed Commissioners Rick Bauman and Jamee Folk to a committee with the Road Superintendent to evaluate engineering proposals in response to an RFP; rate sheets were requested by Feb. 11, 2025.
With no further business, the board adjourned at 12:51 p.m. The next regular meeting is scheduled for Feb. 20, 2025, at 9:00 a.m. at the Mercer County Government Center in Stanton.
