Commission rejects $28,000 easement offer for Coyote Creek Road; final resolution placed on Aug. 20 agenda

A dispute over the 18 ST SW road easement involving Coyote Creek Mining took center stage Aug. 6 when Commissioner Casey Voigt recused himself and reported he would provide the needed easement for $28,000, asserting the road was established by prescription. States Attorney Todd Schwarz relayed information Voigt had provided and gave Voigt the floor to explain the offer.
After discussion, Commissioner Mark Pierce moved to reject the $28,000 offer as unreasonable; Commissioner Jamee Folk seconded and the motion carried. The minutes record the action as approved by the board. NACCO representative David Straley said a binding resolution between the mine and the county still needs to be negotiated; he and county staff agreed that the "Final Resolution of the 18 ST SW Road Easement" would be placed on the Aug. 20, 2025 agenda for further consideration at 11:00 a.m.
The minutes note that the lease agreement between the mine and the landowner is a separate, private matter. The board did not approve any payment or easement transfer at the Aug. 6 meeting and directed staff to continue efforts toward a negotiated resolution for the Aug. 20 session.
