Mercer County sets $1,000-per-acre compensation for roadway across Voigt property, approves easements

The Mercer County Commission on Sept. 17 approved an amendment to a prior motion establishing a roadway across land owned by the Voigt family, setting compensation at $1,000 per acre for a total of 10.29 acres and directing that the road be established on attached easements (Addendum A). Commissioner Jamee Folk moved the amendment and Commissioner Mark Pierce seconded; the commission recorded an unanimous vote in favor.
State's Attorney Todd Schwarz presented a Coyote Creek Road resolution explaining the need to amend the county's existing agreement with the mine because the new, agreed route does not follow the quarter-line alignment contained in the earlier contract. Schwarz told the commission that once the drafted easements are signed the county will have to amend the current agreement between the mine and the county to reflect the new route.
Commissioner Casey Voigt recused himself from the discussion and vote; the minutes record the recusal but do not provide a public statement of reason in the transcript. The motion passed with “all voted aye,” as recorded in the minutes.
The commission did not specify a timeline in the minutes for execution of the easements or for filing the amended agreement; the item was recorded as carried and next procedural steps are limited to signing the easements and amending the existing contract once those documents are in place.
