Mercer County approves zoning changes, abatement; P&Z appointment ties and is deferred

Tax Director and Land Use Administrator Jennifer Neumiller presented several planning and zoning items at the Mercer County Commission meeting on Jan. 21, 2026. The commission approved Zoning Case 26-01-01, an application from Andy and Sarah Thomas for a non-farm residence, and Zoning Case 26-01-02, an amendment to an existing conditional-use permit for Coteau Properties after Darren Hellman, a representative of Coteau Freedom Mine, answered commissioners' questions.
The board also approved a tax abatement related to removal of buildings for Paula Lavelle. The motions to approve the zoning cases and the abatement were passed by unanimous vote, recorded as "all voted aye."
Commissioner Jamee Folk moved to appoint Andy Thomas to the Planning & Zoning Board; Commissioner Casey Voigt seconded. Folk and Voigt voted in favor, while Commissioner Gene Wolf and Chairman Rick Bauman voted against the appointment. With the vote tied, the motion failed to carry and the item was moved to the next regular meeting for further consideration.
The commission reappointed Commissioner Jamee Folk to the Dakota Central Zone Board by unanimous vote.
