Parish council adopts package of ordinances including Paul Angelle Park servitude and park fees

At its Feb. 3 regular meeting the St. Martin Parish Council adopted multiple ordinances addressing traffic, property rights, park fees and zoning.
Ordinance 26-02-1532-OR raised the speed limit on Division Road (Arnaudville) to 45 miles per hour and established misdemeanor penalties for violations. The measure passed unanimously.
The council approved Ordinance 26-02-1533-OR authorizing Parish President Pete Delcambre to enter an encroachment agreement to resolve litigation titled "Delayne Fuselier v. Adrus Boudreaux Complete Title, et al.," Docket No. 93003; the ordinance affirms that the underlying drainage servitude remains in place except as modified by the signed encroachment agreement.
Ordinance 26-02-1534-OR set campsite fees at Uncle Dick Davis Park at $30 per day, with a reduced $20 per-day rate for seniors (60 and older) and veterans (as defined in 38 U.S.C. 24101(2)); revenue is earmarked for maintenance, salaries and park improvements.
The council adopted Ordinance 26-02-1535-OR amending the parish road zoning data sheets to change a portion of Andrew Gautreaux Road (1029 Andrew Gautreaux Road) from R-2 (Mixed Residential) to C-2 (General Commercial) while the listed property remains owned by Jacob Randall Berard and Parris Regina Courville Berard; the commercial classification reverts should ownership change.
The council also adopted Ordinance 26-02-1537-OR, accepting an exclusive personal servitude of use over 4.252 acres adjacent to Paul Angelle Jr. Recreational Park for youth activities. The servitude includes a 10-year term (subject to the "natural life" clause described in the ordinance), a right of first refusal if the owners decide to sell, and explicit conditions: use limited to recreational programs for youth 18 and younger; maintenance of an existing chain-link fence; a prohibition on alcohol on the premises; restriction on vehicles except for maintenance; and access limited to the tract referenced, the Paul Angelle Jr. Recreational Park, or parish-owned property. Parish Attorney Lee Durio explained owner-requested amendments to the ordinance before adoption.
All of these ordinances were recorded as adopted by unanimous council vote in the meeting minutes. The council closed the public hearing on the ordinances after hearing public comment and directing staff and legal counsel to incorporate agreed amendments where noted.
