The Richardson Zoning Board of Adjustment voted unanimously to grant special exception SE25-02, allowing an 8-foot wooden fence in the required front yard along Chapel Creek Court at 3105 Canyon Creek Drive. Staff recommended approval after reviewing code standards and similar neighborhood conditions.
Planner Aaron Zills presented the case, explaining that the corner lot has two front yards because of a 35-foot platted building line and that portions of the subject property already have an existing 8-foot wooden fence. Zills said staff found similar conditions at other corner lots in the subdivision and concluded the request would not negatively impact neighbors and would preserve required visibility triangles.
Homeowner Nash Riosk, the applicant, said he bought the house to use the backyard and wants to provide a safer, usable space for his children: "The reason why we bought the home was for the backyard purposes... I have 2 kids." Jeff Hamilton, a nearby homeowner, testified in support, saying other corner lots have similar fences and that he had not seen safety issues where property lines were extended.
Bill Weeks, speaking for an adjacent resident, raised a procedural objection arguing the public notice might be unclear if the relief sought differs in location from the notice; staff and another city representative explained the map colors and said the red line on the exhibit shows the proposed fence area to the right of the 35-foot building line (the area treated as required front yard), and that the fence would be offset from the sidewalk by roughly 1.5โ2 feet.
After staff clarified the mapping and answered board questions about offsets and visibility, a board member moved to grant SE25-02 limited to the specifics presented; the motion passed unanimously. The applicant may now proceed to the building department to secure permits consistent with the approved exception.
