Big Horn County approves annual MOU with Beartooth RC&D, sets local match

The Big Horn County Board of County Commissioners unanimously approved a memorandum of understanding with the Beartooth Resource Conservation and Development Area, Inc., at its Dec. 4, 2025 meeting in Hardin.
Deputy County Attorney Heather M. Ready reviewed the agreement and told the board it was substantially the same as prior years' arrangements. Commissioner George Real Bird III moved to approve the MOU; Commissioner Larry Vandersloot seconded the motion, which passed unanimously.
The attached MOU says the county's annual contribution will be $1,986.95, which includes a $750 membership fee and a per-capita assessment of 9⅔ cents based on a 2024 population figure of 2,796. According to the document, those local matching funds are intended to help secure approximately $570,000 in federal Economic Development Administration funding to support a regional economic development director and related activities.
The MOU text submitted with the packet outlines regular bi-monthly board meetings, annual evaluation and reporting requirements, document-ownership provisions, insurance and indemnification requirements, nondiscrimination provisions, and a termination clause requiring written notice and an opportunity for consultation. The memorandum also specifies that the agreement is governed by Montana law and that venue for disputes is the Twenty-Second Judicial District, Big Horn County.
The MOU as included in the meeting packet lists a term "from January 1, 2028 through December 31, 2026," a sequence that appears inconsistent on its face; the board approved the agreement as presented in the packet. The county clerk's office should be consulted for the intended effective dates if required for contracting or audit purposes.
The board did not record any amendments to the MOU language during the meeting. The commission took the approval under advisement for execution consistent with county procedures.
