The Big Horn County Board of County Commissioners unanimously approved Oct. 16 updates to the county's Facilities and Fairgrounds Event Use Agreement that adjust insurance and indemnity requirements while leaving fee schedules unchanged. Deputy County Attorney Heather Ready presented the revisions; Commissioner Larry Vandersloot moved the approval and Commissioner Lawrence Big Hair seconded.
The updated agreement distinguishes large, midsized and small events and sets minimum liability insurance amounts for large events (example: $750,000 per claim/$1.5 million aggregate) and lower minimums for midsized events. It requires a Certificate of Insurance and an endorsement naming Big Horn County as an additional insured for large and midsized events and mandates workers' compensation coverage or an independent contractor exemption certificate. The text also states that community events with no ticket sales and no food or goods sold may be eligible for an insurance waiver ("Small Event" classification).
The contract includes an indemnification clause that requires users to defend and hold harmless the county for claims arising from the user's event or renovation activities. The draft also clarifies county access for inspections, rules on alcohol sales and broadcasts, vendor and signage restrictions, requirements for food and temporary food permits, damage deposit and key-fob return rules, and a right of first refusal for future event dates.
The minutes record that fees were not changed; only insurance requirements were revised. The agreement spells out administrative contacts (names and phone numbers) and procedural steps for submitting certificates of insurance, W-9s, and event logistics. The board approved the revisions without recorded opposition.
