Commission recommends Care/Carapol minor subdivision, requires mapping of irrigation pipeline and centerline

The Montrose County Planning Commission on Jan. 23 recommended approval of the Care (transcript also shows variant spellings) minor subdivision, subject to identifying and labeling irrigation infrastructure on the recorded plat.
Planning staff presented the application to split three lots from a 9‑acre parcel on 6450 Road; staff recommended approval. During public comment, an adjacent landowner who identified themselves as Customer McEachran asked whether "our water rights go right through that property" and whether the developer "are they gonna be responsible to cover the water rights, or do we have the right to go on that property?" McEachran also asked how many homes could be built on the parcel.
Another neighbor, Shelley Keefer, asked for clarification about zoning and whether the parcel’s projected land‑use in the new master plan could support rezoning to commercial or industrial uses in the future. Keefer asked, "So then there would be, a rezoning meeting like this then?" Staff explained rezoning would require a separate application and public hearing with notice to surrounding property owners.
Commissioners focused discussion on the presence of an unrecorded underground irrigation pipeline and on how to preserve historic maintenance access for neighbors. Staff and the applicant agreed to label the centerline of the irrigation ditch and any known pipelines on the plat (without assigning a fixed width) and to add a legend noting the centerline location; the commission made that labeling a condition of approval. A commissioner moved to approve the minor subdivision with the added condition; the motion was seconded and passed by voice/hand vote.
The condition requires the applicant to identify the underground pipeline and show the irrigation centerline on the recorded plat so neighbors’ historic access and maintenance rights are clear; the planning commission’s recommendation will be forwarded to the Board of County Commissioners.
