The Montrose County Planning Commission on March 27 recommended denial of a rezoning application that would change a 2.77-acre parcel at 17697 Highway 550 from general agricultural to general commercial.
Staff explained the parcel sits inside the county’s urban growth boundary but outside the commercial node the master plan designates for growth; while the applicants said they planned to move an existing business to the site, staff and commissioners warned that rezoning to general commercial could allow any use permitted in that zone and thus create precedent for spot zoning along the highway.
The applicant, Gerard Ocivantes, told the commission he intends to operate a modest business and said the site is not intended for hazardous materials. Commissioners expressed concern that approval could undercut the county’s node-based master-plan approach and that sewer infrastructure is not nearby, which limits near-term commercial viability.
A commissioner moved to recommend denial on master-plan and precedent grounds; the motion was seconded and passed unanimously. The commission will forward its recommendation to the Board of County Commissioners, which will consider the case on April 16.
