Council approves $2.07 million participation for Emerson sewer oversizing to serve multifamily project

The Cleburne City Council on Jan. 13 approved an amendment to the development agreement with LMBP 1050 LP that increases the city's participation for oversizing sanitary sewer mains to a maximum of $2,069,916.97 to serve the Emerson multifamily development.
Staff explained the change reflects final construction bids and design revisions — including a creek crossing and grade adjustments — that increased costs compared with preliminary estimates. The oversizing (from an 18-inch line to a 42-inch line in certain segments) is intended to allow the sewer main to serve a broader area in the future and avoid the need for a parallel line later.
The council was told funds are available in the budget (about $3.5 million set aside for Phase 1) to cover the city's reimbursement and that the amendment preserves the original agreement's requirements while updating reimbursement amounts to match actual bids. “The design did change through the design process,” Jeremy said, describing site-specific changes and final bids as key drivers of the higher participation figure.
Councilmembers asked questions about scope changes and the reason for the cost increases; staff pointed to design adjustments and creek crossing complexity rather than only market escalation. The motion to approve the amendment passed unanimously by voice vote.
Staff will proceed under the amended agreement and coordinate design for future segments so the city can construct additional portions when ready.
