Council approves emergency FM4 roadway work and authorizes eminent-domain steps for FM4/Cardega water main

Emergency roadway work: Public Works staff explained that TxDOT moved its reconstruction schedule out of the near term, leaving the city with newly relocated utilities and a roadway that requires full-width restoration to hold traffic for an extended period. Staff recommended an emergency change order and repayment under Texas local government code (Section 252.022) to allow milling and overlay work and to minimize the duration of corridor closure. Council approved the change order in the amount of $656,217.90 and authorized an additional $75,000 contingency to complete the restoration.
Easements and eminent domain: For a related but distinct project — the FM4-to-Cardega Road 16-inch potable water transmission main — staff reported approximately 7,000 linear feet of new 16-inch main is planned. Three of five needed easements were obtained through negotiation; two remained unresolved. Council authorized the city attorney and staff to pursue eminent-domain proceedings (resolution RS12-2025-8) to acquire necessary permanent and temporary construction easements if negotiations cannot secure agreeable terms.
Council members emphasized that the schedule change was caused by TxDOT funding/timing changes, not by city actions, and noted the importance of restoring the corridor as soon as reasonably possible.
