The Deuel County Board of Adjustment on Feb. 9 approved a variance to Section 1101.05 allowing Ron and Kathy Gorder to construct an approximately 62-by-272-foot hoop barn within the 65-foot front-yard setback required by ordinance. The approved placement requires the structure be no closer than 42 feet from the road right-of-way.
Grange Township previously approved a reduced setback contingent on the applicants removing snow from the road right-of-way caused by the new structure. An adjoining-property waiver from Brock Bahr, whose residence is roughly 298 feet from the proposed barn, was submitted and accepted to address required separation distances. The applicants told the board they intend to apply for a Class D CAFO permit (which can cover up to 999 animal units) but stated the operation would be limited to no more than 499 head of cattle; they indicated current plans for the new barn to house up to about 250 head.
Because the parcel is located outside the aquifer protection area, the board noted that, based on the number of animal units proposed, a nutrient management plan, manure management plan and fly/odor control plan are not required under Section 1304.6.2. The board approved the variance by motion (moved by Dennis Kanengieter, seconded by Mike Lammers). All members present voted in favor. The Findings of Fact and Conclusions of Law are on file with the Zoning Office.
