Planning commission tables Rochester Ranch Retreat CUP, requests neighbor notice and public hearing

On Feb. 11, 2026, the Emery County Planning and Zoning Commission voted unanimously to table a Conditional Use Permit application for Rochester Ranch Retreat, a proposed short-term cabin and RV rental dark-sky stargazing operation south of Moore Cut-Off Road.
The commission asked staff to notify adjoining property owners, hold a public hearing at the next meeting, and research the property’s legal conforming lot status and ownership history before the permit is considered again. The property was described in the packet as approximately 6.01 acres and not being subdivided; commissioners noted county guidance generally requires 10 acres for business use and raised the question whether the parcel pre-dates current ordinances.
Commissioner Bart Cox moved to table the application for one month to allow the steps above; Commissioner Bruce Wilson seconded and the motion passed unanimously. The motion, as recorded, directs outreach to neighboring landowners and scheduling the item for the March meeting.
Commissioners identified potential neighbor impacts to be considered at the public hearing, including noise, traffic and recreational-vehicle use associated with short-term rentals. They also requested clarification on the county resolution that governs legal conforming lots and how it applies to conditional use permits on pre-existing parcels.
Next steps: staff will attempt to verify the parcel’s legal status and publish notice to adjoining property owners. The Commission will take public testimony and reconsider the application at its next meeting, scheduled March 11 at 11:00 a.m.
