Sioux County adopts wind and solar rules; NextEra road and decommissioning agreements continue under revision

Sioux County commissioners approved amendments to their Wind Energy Installation Regulations and adopted a new Solar Energy Conversion Systems regulation after a public hearing that drew questions about decommissioning, bonding, road impacts and reclamation.
The board’s records show repeated, scheduled meetings with NextEra Energy Resources and legal counsel starting Jan. 2, 2025, where Road Use and decommissioning agreements were reviewed. On Feb. 3 the board approved a Road Use Agreement; the decommissioning agreement was discussed and wording changes were directed to be made for final review at a subsequent meeting. On March 3 the board approved a decommissioning proposal for the Sioux County Wind Farm, LLC proposal, while noting further edits could be required.
At the Sept. 2 and Sept. 26 meetings the board held a public hearing on proposed amendments and, after public questions about roads and reseeding, voted to approve the wind regulation amendments and the solar regulations. The minutes record the board also extended a moratorium on accepting new solid-waste disposal applications for six months to allow additional review of such proposals in the county.
County files show NextEra’s project team (represented by David Levy of Baird Holm and Austin Paxson of NextEra) participated in multiple sessions; the Road Superintendent and county attorney provided technical and legal review and requested specific wording changes in decommissioning language. The decommissioning and Road Use agreements are recorded as to be revised and returned for final approval at targeted future meetings (February–March 2025 and later follow-ups).
Separately, federal land management officials informed the board in August that the Department of the Interior had directed a pause on wind and solar projects affecting certain national monuments; county staff noted that federal actions may affect project timelines.
Next steps recorded in meeting minutes include finalizing decommissioning language, receiving remaining environmental reports, and formal review of final agreements before execution.
