Smithfield council gets legal briefing on LUDMA, quorums and meeting rules

Seth Tait, an attorney with Logan-based Olson & Hoggan, provided a legal training to the Smithfield City Council and Planning Commission during a specially scheduled meeting on Feb. 25, 2026. Mayor Aaron Rudie presided; the session began at 6:00 p.m. and adjourned at 7:11 p.m.
Tait framed the session around the Land Use, Development and Management Act (LUDMA) and the line between legislative decisions — taken by elected bodies — and administrative decisions handled by staff or administrative hearing officers. He listed examples to illustrate the distinction: annexation, zoning and general-plan amendments are legislative; subdivisions, conditional-use permits, accessory dwelling unit (ADU) permits, business licenses and building permits are administrative.
The attorney also addressed local references and procedural rules, including Code Section 17.08.040 on rezones and the Utah Public Meetings Act. City staff and commissioners recorded clarifications about quorum requirements: a quorum of the Planning Commission is four members; a quorum of the City Council is three members. Tait discussed when closed meetings are permitted under state law and urged adherence to open-meeting protocols.
Council and staff discussed best practices for interactions with developers and residents, and for handling public input at planning and council meetings. Tait emphasized limits on informal communications among members (such as email or text) and the importance of following statutory notice and disclosure obligations to avoid ex parte contacts in land-use matters.
The training included a question-and-answer period with council members, staff and planning commissioners. The posted agenda for the session stated that public comments would not be accepted. No formal motions or votes were taken at the meeting.
The meeting packet and minutes list city staff in attendance, including City Manager Justin Lewis and City Recorder Dana Lazcanotegui, and Planning Commission members Jim Marshall, Klydi Heywood, Michael Beckstead, Jon Meier and Lane Henderson. The council adjourned at 7:11 p.m.
