Moody Council upholds euthanasia order after hearing on dangerous dogs

The Moody City Council on Feb. 14 upheld an Animal Control Officer's Order of Euthanasia for two dogs owned by Bobby R. McKleroy after a hearing before Mayor Joe Lee and the council.
City Attorney James Hill told the council of its role under Ord. M2001-07-09 in reviewing an appeal of the Order. Reece Smith presented video from the victim's house that the record describes as depicting the events that led to the Order. Lee Barnes, the owner of the deceased dog, described prior attacks and said he was concerned about future attacks on pets or children. Mr. McKleroy questioned whether both of his dogs were involved in the incident shown on the video.
Council Member Lynn Taylor moved to uphold the Order and to schedule the euthanasia for Feb. 22, 2022 to allow Mr. McKleroy the opportunity to appeal the council’s decision to the Circuit Court; Council Member Matt Morris seconded. The council voted in favor by recorded voice vote; the minutes state the motion carried and the hearing was closed at 6:47 p.m.
The council’s action enforces the Animal Control Officer’s Order under Ordinance M2001-07-09 and sets a compliance date; the decision was entered on the meeting record and the affected parties were advised of appeal rights to circuit court.
