County advances proposed herd-district ordinance, schedules April hearing

Franklin County commissioners moved forward with a proposed Herd District Ordinance after a presentation by Sheriff Cuyler Stoker.
Stoker said he had reviewed the draft with Brand Inspector Gene Love, who endorsed the changes. The ordinance adds a definition for "large animals," includes an "Act of God" exemption, and sets enforcement authority at the criminal level while preserving the option for civil action. The Brand Inspector and the Certified Feed Lot will determine amounts owed when cattle are held while owners are located. Commissioners directed staff to publish public notice and post signage in three locations in each herd district as required; they set a public hearing for 6:30 p.m. on April 22, 2026 to consider dissolving or changing herd districts and adopting the ordinance.
County Attorney Vic Pearson advised that both publication and posting in three places within each herd district are required for public notice. Commissioners indicated they would move forward to advertise the proposed changes and schedule the hearing.
