Rep. Smith's bill to clarify Florida Virtual School governance reported favorably

The PreK–12 Budget Subcommittee voted to report House Bill 129 favorably after Representative Smith described the measure as a set of statutory clarifications for Florida Virtual School.

Representative Smith told the panel the bill addresses five areas raised in a 2019 audit, including clearer rules for when the president and CEO may call board meetings, confirmation that Florida Virtual School operates as a public school (often functioning like an independent district), retirement system eligibility for full‑time teachers, rules for direct support organizations, and procedures for coordinating proctored tests with local schools. "The bill really accomplishes, 5 things," Smith said during her explanation.

Smith also disputed concerns about access: "There's never been any wait list in Florida Virtual School," she said, explaining the program's distributed, computer‑based model.

One witness, Melanie Bostick of Florida Virtual School, registered support on the committee appearance card. Representative Daniels, in debate, described the program as personally meaningful, saying it had been "more than a blessing to my family" and expressing support for the bill.

After the committee discussion, the clerk called the roll. By recorded vote the subcommittee reported HB 129 favorably; the clerk recorded yes votes from the listed members and two members were excused. The committee did not adopt any amendments in the hearing and Representative Smith closed seeking cosponsors.
