Commission denies request to reduce $24,500 tree-removal lien at Pelican Reef Drive

A nearby lot had a different fine outcome, and the owner’s counsel asked the commission to make this lot’s penalty consistent with its neighbor.

Public commenters argued the original $24,500 fine was the correct deterrent and voiced concern about a pattern of lot clearings. The owner's attorney explained procedural reasons for the different outcomes and said the special magistrate and staff had recommended the reduced lien to match the adjacent property.

Commission debate focused on enforcement precedent and whether earlier magistrate decisions should control the outcome. After discussion, the mayor moved to deny the reduction, and the roll-call vote carried (majority in favor), leaving the original lien amount in place for the property owner to address.
