The Planning and Zoning Board approved an after‑the‑fact setback variance for an accessory shed at 81 Coquina Avenue on Jan. 6, but limited the approval to a storage shed tied to the dock use.
Applicant Jamie Pantling testified the shed sits roughly 2.8 feet from the north property line; code requires 3 feet for nonresidential accessory structures. Pantling explained survey inconsistencies — he said earlier surveys were poor and he relied on a physical monument and fence lines for placement. "My survey came back... I'm 2.8 feet off the north property line instead of 3 feet, and I'm asking for that variance for 0.2 feet," Pantling said.
Board members debated whether the condition was created by the owner or by survey inconsistency and expressed concern about granting a permanent variance that "runs with the land." Several members said a narrowly framed motion that ties the variance to the existing, nonresidential accessory use (a storage shed associated with the dock) satisfies board concerns. One board member noted that if a future owner sought to convert the structure to a residential accessory building (guest house), that conversion would require separate review and would not be covered by this variance.
A motion to approve variance PZV 2025‑0097 with the condition that the variance apply only to the storage shed related to dock use passed on a roll call (six yes, one no). The applicant thanked the board.
