Gainesville commission directs staff to draft charter language clarifying how vacancies are filled

The General Policy Committee instructed city attorneys on Feb. 26 to draft charter-amendment language that would clarify how vacancies on the Gainesville City Commission are filled and to aim for placement of language on a November referendum.
Under the city's existing charter, vacancies with less than six months remaining can be filled by appointment of the remaining commissioners; vacancies where more than six months remain typically trigger a special election. The City Attorney recommended a cleaner approach: appointments by the remaining members to serve until the next regular election for vacancies occurring near the qualifying period, and clearer ballot language so voters understand the interim appointment mechanism. The attorney also recommended against overloading a single ballot question with both routine vacancy language and provisions for highly unlikely, extraordinary mass-vacancy scenarios because that could confuse voters.
Commissioners expressed a preference for November placement to maximize turnout and asked staff to check supervisor-of-elections deadlines and return draft language for first reading. The commission will consider the draft in an upcoming meeting; staff indicated a goal of forwarding language in time for the November ballot if the commission directs proceeding.
