The agreement includes a provision that requires the owner to relinquish the right-of-way area “should when and if the county requires that right of way back for either roadway expansion or any other purposes,” and it allows the county 30 days to reclaim the area. County Attorney Christie Fox told the board she had reviewed and approved the agreement language.
Commissioners moved and seconded the acceptance and voted in favor.
Why this matters: allowing temporary use of right-of-way can facilitate private development while preserving the county’s ability to reclaim land for public purposes. The 30-day relinquishment clause explicitly preserves the county’s ability to resume the right-of-way for future roadway projects.
