The Hinckley Planning and Zoning Commission on Feb. 17 voted to forward a proposed Future Land Use Map/Official Zoning Map to the Town Council, requiring the town to complete all notification steps mandated by town code before final adoption.
Commission Member Joy Partridge raised a procedural objection under Town Code 10‑16‑4, saying owners within 300 feet of proposed zone changes must be notified by first-class mail and that the town had only notified directly affected parcel owners. Town Clerk Tresa Taylor responded that the map before the commission was a proposed map and that additional public hearings with proper notification would be held before any final zoning adoption.
The commission also debated several parcel-specific proposals. Commissioners discussed adjusting Justin Louder’s property to R‑3 across three sections, redesignating the cemetery as municipal non‑profit, and keeping commercial zoning available along Highways 6 and 50 on the town’s south side to allow future commercial development without forcing immediate agricultural-use changes. The commission addressed Hathaway and Crop properties proposed to change from General Commercial to residential designations and said conditional use permits in residential zones could allow many intended uses while limiting nuisances. Commissioners additionally affirmed that new residents must accept existing agricultural operations in line with right‑to‑farm expectations.
Commissioner Clark Mortensen moved to send the proposed map to the Town Council with the condition that the town follow all notification steps required by Town Code 10‑16‑4 and conduct subsequent public hearings. Commissioner Margene Stevens seconded. Roll-call vote: Joy Partridge — no; Margene Stevens — yes; Clark Mortensen — yes; Joe Taylor — yes; motion carried 3–1.
The motion sends the proposed map and its parcel-level recommendations to the Town Council for formal consideration; the council must verify notice requirements and schedule additional hearings prior to any ordinance changes or final map adoption.
