The Cass County Plan Commission authorized enforcement action to clean up 1475 Linley Street and approved similar enforcement timelines and fines for several other properties during its meeting.
Enforcement staff described the Linley site as containing roughly a dozen to 16 vehicles, RVs and large amounts of junk and said the department had issued notices and a $5,000 fine letter as part of the unsafe‑property process. Staff presented two estimates for full cleanup: Williams Excavating for $19,500 and Jay Shidler for $24,900. Commissioners discussed the practical limits on scrapping vehicles without titles, the possible need for court‑ordered titles or DMV checks and the option of itemizing contracts on a per‑vehicle basis.
After discussion the commission moved to authorize cleanup using a lowest‑bid approach and to proceed with lien/fine recording where appropriate. The body discussed that the department budgeted $30,000 for cleanup work this year.
The commission also acted on multiple other enforcement items: it cleared the case at 3775 West 500 North for Mr. Spencer after staff said he had completed requested cleanup; it gave Mr. Chambers at 1451 West 350 South a 60‑day period for repairs with inspection on April 1 and review at the April 7 meeting; it assessed a $1,000 fine (with an additional $1,000 possible) and set a 30‑day permit deadline for demo work at 1556 West Pich Street (Jones) and at 1564 Fitch; and it granted Mr. Fleener until May for an on‑site inspection and follow‑up. William Lemmon, whose property was discussed, told the commission he plans to demo in mid‑April to May and agreed to obtain a demo permit.
Commissioners and staff repeatedly emphasized process constraints: vehicles typically require titles to be scrapped and the department may pursue title/DMV processes or tax‑sale liens if owners do not comply.
