Posey County imposes fine and tables complaint as building commissioner reports on nuisance cases

Posey County Building Commissioner Ed Battieger updated the Board of Commissioners on several nuisance matters during the Jan. 6 meeting.
Battieger reported that work at an address on Highway 69 South has stopped and the property is deteriorating. Commissioners noted the complaint dates to March 2025 and voted 3-0 to impose a $250 fine and authorized Battieger to send a letter to the owner. No fines had been issued previously, the board said.
On Copperline Road, Battieger reported the nuisance complaint has been resolved to his satisfaction; commissioners voted 3-0 to close that complaint.
Battieger presented a new complaint at 3921 Davis Road concerning trash and junk in the yard. Owner Gary Lindsey spoke during the public portion, said he would work on the property, and was asked to coordinate with Battieger. Commissioners tabled the complaint to the Feb. 3, 2026 meeting to give the owner time to address the issue; the motion passed 3-0.
The board’s actions mix enforcement (fine for Highway 69) with administrative closure and a temporary hold on the Davis Road case to allow remediation by the property owner.
