Commission approves Northwest Rural Water District permit for Road 11 after warranty concerns

The Big Horn County Commission voted Jan. 21 to approve a permit allowing the Northwest Rural Water District to cut County Road 11.
The permit had been tabled previously because county Road & Bridge staff did not receive a warranty guarantee similar to one provided by another district. Road & Bridge representative Bridges raised the matter, and T. Rutherford of the Northwest Rural Water District explained why work on the cut and subsequent repairs had lapsed.
Commissioner Bruce Jolley moved to approve the permit for Road 11; the motion passed after discussion. Commissioner Dave Neves said he has observed ongoing problems with cuts in paved roads during his time on the commission and urged adding a repair time limit in addition to the permit’s existing usage limits.
Chair Deb Craft said the commission is cautious about approving cuts and noted that many permits are denied; staff and Rutherford discussed an example warranty used for another permit and provided it as context for future approvals.
Next steps: Road & Bridge staff will work with the Northwest Rural Water District to document repair timelines and warranty terms for the permit file. The commission did not record an amendment to the permit at the meeting.
