County counsel reports $5 million proposed settlement in Silva et al.; Orange County board approves several settlements

County counsel reported that the Orange County board unanimously approved several closed-session settlement actions and delegations, including a proposed $5,000,000 settlement in Silva et al. v. County of Orange, the counsel said during the public session.
The proposed $5,000,000 settlement relates to a personal-injury claim arising from an automobile collision with a county truck on the 5 Freeway, counsel said, adding that "liability was not disputed." The board approved the proposal subject to final approval by other parties; counsel said copies of the settlement agreement will be made available through the Office of CEO Risk Management to anyone who inquires.
Counsel reported the board also took these actions: it delegated limited settlement authority to county counsel and outside counsel to resolve various harassment and discrimination claims by current and former district attorney's office employees (SCS 2); it delegated limited settlement authority to the CEO Risk Management office for a case involving an incarcerated person who fell from an escalator while being escorted in the men's jail (SCS 4); and it delegated settlement authority for an industrial injury sustained by a county employee in a warehouse accident (SCS 6).
The board unanimously approved several other proposed payouts, counsel said: a proposed $75,000 settlement in Perez v. County of Orange, a case alleging harassment and misconduct by a deputy sheriff at the O'Lacey facility (SCS 5); a proposed $420 settlement in Wallace v. County of Orange, involving cumulative trauma claims by a retired sheriff special officer (SCS 7); and a proposed $45,000 settlement in Nicholas Crischione v. County of Orange arising from a collision involving an on-duty deputy responding code 3 (SCS 8). Counsel said each of those approvals "remains subject to the final approval of others." Copies of those settlement agreements will likewise be available through the Office of CEO Risk Management upon request.
Counsel concluded by reporting that the board "took no other reportable action" in closed session. The chair then closed the meeting and the board left the record. The reported settlements and delegations remain subject to any further approvals required by relevant parties or procedures.
