Law director sees no objection to Viva Fiesta liquor permit; council places transfer on agenda

At the start of its Dec. 2 meeting the Brook Park City Council heard a liquor-permit matter for Quality Food Solutions LLC (doing business as Viva Fiesta) at 16099 Brook Park Road.
Law Director Carol Horvat told council she had reviewed the request related to the Captain Taco premises and found no legal objection. "I find nothing objectionable to this, and I would, certainly recommend that counsel allow this to proceed," Horvat said.
Council members asked whether the filing was a new license or a transfer and whether the city imposes a numeric cap on liquor licenses. Horvat and other council members explained that license allocations and limits are administered by the State of Ohio and that Brook Park ordinances do not set a fixed numerical cap. A council member noted states sometimes "trunk" licenses from one jurisdiction to another when a locality has unused allocations.
After the discussion the council voted to place the liquor item on tonight's council agenda under letter M-1 for future consideration. The motion to place the item was supported and carried by roll call.
The action tonight was procedural: council placed the permit matter on the agenda for formal consideration rather than granting or denying a license. Any final decision will be recorded in future council minutes when the item returns.
