Brook Park council adopts ordinance to accept stadium-area parcels, enabling expanded TIF options

Mayor Ed Orcutt described the measure as a "housekeeping" action to put the city in the chain of custody for the parcels so the city can pursue different tax increment financing (TIF) options. "This allows us to do a 41 TIF," Orcutt said, explaining the distinction he and staff presented between a 40-B TIF, which generally funds infrastructure, and a 41 TIF, which can be used toward building costs.
The mayor framed the move as a tool to build dedicated funds for long-term maintenance and sustainability of the project site, saying the city wants to avoid what he described as shortcomings in the prior development agreement. "We cannot make that same mistake," Orcutt said, adding the arrangement would let Brook Park be part of the chain of custody for the property and therefore eligible for additional financing structures.
Legislative Committee Chair Councilman Scott introduced the ordinance and turned the floor to Orcutt. Council members expressed support during the caucus: Councilman Poindexter said he believed the 41 TIF would be "the best move for our city" and regional partners because it builds funds for long-term upgrades; Councilor Mancini and others voiced concurrence.
Council debated and then moved the ordinance to a special council meeting for immediate consideration. The council voted to suspend the rules and adopted Ordinance 11508-2025 under suspension; the council president announced the ordinance had passed under the suspension of the rules.
The ordinance references statutory authority in the Ohio Revised Code relevant to TIF-related conveyances. The special meeting record shows the council voted to adopt; the transcript documents recorded roll calls during placement on the special agenda and during the special meeting, including an abstention when placing the item on the special meeting agenda.
Next steps: with the ordinance adopted, the administration said it can proceed with the conveyance and reconveyance steps that would allow Brook Park to pursue the 41 TIF option for the stadium-area project.
