Planning commission approves land‑use amendment and rezoning for 7267 North Buffalo Road; subdivision tabled over survey errors

Chair Brent Roggow opened the Nov. 12 meeting of the Lincoln County Planning Commission and the panel approved a change to the county’s future land‑use map and a rezoning that together clear the way for a residential lot split at 7267 North Buffalo Road.
County Planner Judy Clark told commissioners the applicants asked to amend the map from Transitional Agricultural to Residential Acreage to allow the property to be rezoned and split. Clark said the surrounding area already contains smaller residential lots and staff recommended approval of the land‑use amendment to accommodate the requested lot split.
Commission member Aaron Edwards moved to table all three related agenda items (the map amendment, rezoning and subdivision) because of multiple problems he identified in the plat and what he described as a survey that was “very wrong.” After discussion with staff and legal counsel about what hearings could legally proceed, Edwards amended his motion to table only Item No. 6, the subdivision application, so the commission could act on the map amendment and rezoning once survey/legal descriptions are corrected.
Edwards then moved to adopt Resolution AM24‑001 “A,” recommending approval of the Future Land Use Map amendment for the tract described as a portion of the W½ of Section 8, Township 14 N, Range 30 W, 6th P.M., Lincoln County. Lee Davies seconded the motion; roll call was recorded as Moorhead, Flaming, Boden, Roggow, Edwards, Pederson, Davies, Eickhoff and Miller voting aye, with no nays and Rayburn and Merritt absent. The motion carried.
Under the closed hearing for the rezoning, Zak Eickhoff moved and Mitch Moorhead seconded adoption of Resolution Z24‑001 “A,” recommending rezoning the property from TA‑1 Transitional Agricultural to R‑1 Rural Estates to permit the proposed lot split. The motion passed by the same roll‑call tally.
File SU24‑008 (Splitt Creek Acres), the subdivision application tied to the rezoning and map amendment, was tabled under the amended motion. Applicant Eric Hansen requested a list of corrections to the plat and survey; Planner Clark said she would email the necessary corrections to him.
The commission’s actions allow the land‑use amendment and rezoning to proceed pending corrected survey/legal descriptions and a subsequent filing for subdivision approval. The applicant will be expected to submit a corrected plat and survey before the commission takes final action on SU24‑008.
