Peabody’s Conservation Commission on Feb. 11 told a property owner proposing a garage with a breezeway at 41 Beacon Boulevard to file an amendment to an existing order of conditions after staff found a small portion of the breezeway lies within the city’s 200‑foot locally protected buffer to an intermittent stream.
Commissioners examined plans and GIS records and heard from the owner, who said the proposed garage itself sits outside the commission’s jurisdiction but that approximately 4–5 feet of the adjoining breezeway falls inside the buffer (measured at about 195 feet from the stream edge). The owner told the commission he had retained a wetland scientist for previous site work and that the contractor had identified locations for a pool and well; he said he did not realize the breezeway intrusion until plans were reviewed.
Commissioners expressed concern about the unknown wetland boundary locations and recommended the applicant submit an amendment to the existing order of conditions with clear wetland delineation on the plan so abutters can be legally notified and the matter becomes a public hearing. The chair emphasized the need for a site visit and for DEP comments before the commission would approve any work that affects the buffer zone. The commission voted to continue the item to the next meeting.
