The Grove City Board of Zoning Appeals approved three property variances and postponed its officer elections at a meeting where only two members were present.
The chair of the board opened the hearing by noting one member was absent and warning applicants that a decision would require a unanimous vote. The board postponed nominations and elections for chair and vice chair until the next meeting and permitted one member to serve as acting vice chair for the evening.
The board then considered an appeal for 2811 Dennis Lane, filed by Parks Davis AIS Renovations Limited on behalf of property owner Deborah Asbury, seeking a variance to section 11.37.08(h) to allow a garage height of 14 feet from grade rather than the 13-foot limit. Mr. Davis, the presenter for the project, testified the finished foundation had an extra course of block plus the sill plate that raised the structure roughly 10 inches over the original plan and that he had measured the finished height as "just a hair under 14" feet. The chair moved to approve the variance; by roll call Mr. Brandt and Mr. Andrews voted yes, and the board approved the variance. The chair told the applicant the city council has 30 days to review and potentially overturn the board's decision.
Next the board heard the appeal for 3311 Wohler Avenue (the applicant spoke of the address as "Bowler Avenue"), where owner Sally Toth requested two variances to section 11.37.05: replacing an existing 48-inch white picket fence with a partially solid 60-inch white vinyl fence topped by 12 inches of lattice, and allowing a fence on a corner lot that encroaches the front setback to 0 feet. Toth said the existing fence has been in place 20–30 years and is no longer repairable and that the new fence would remain set back roughly 7–8 feet from the road, so it would not impede motorists. The chair moved to approve both variances; the motion passed by roll call (Mr. Brandt and Mr. Andrews voting yes). The chair reminded the owner to wait 30 days before beginning work to allow for potential council appeal.
The final appeal was for 5886 Platinum Drive, where Cindy Tucker sought a variance to Table 11.35.10 to encroach the 25-foot rear-yard setback by 4 feet for a replacement deck (resulting in a 21-foot rear setback). Tucker said the existing deck is larger and deteriorating and that the proposed composite deck would be smaller, more durable and include railings and lighting. The board approved the variance but added a condition requiring that construction begin within 12 months. The motion, including the 12-month start condition, passed by roll call (Mr. Brandt and Mr. Andrews voting yes). The chair again noted the 30-day appeal period to the city council.
The meeting concluded with no new business and the board adjourning.
The approvals allow the applicants to proceed subject to standard appeal and timing conditions; the city council retains the ability to review and overturn any of the board’s decisions within 30 days.
