Council approves rezoning of 1520 23rd Street to R3 on first reading despite opposition

The Cody City Council approved the first reading of ordinance 2025-37 to rezone Lot 4, Block 2 of Cody Heights (1520 23rd Street) from medium-low-density residential (R2) to medium-high-density residential (R3).
Planning staff summarized the PNC board’s review of the rezoning request, saying the PNC board held a public hearing on Nov. 18 and recommended approval by a 4–1 vote. Staff reported that one adjacent property owner spoke during the public hearing and, after further discussion with the applicant, told staff he had no objection to the zone change. Staff also said that of 12 mailed notifications representing 15 properties, there were four written comments on the rezoning (two opposed and three not opposed) and an additional objection from a property owner outside the notification area. Staff characterized the two written objections as representing 13.33% of the adjacent area within the 140-foot notification boundary.
Council Member Centenary moved to approve ordinance 2025-37 on first reading; Council Member Lang seconded. The council approved the first reading on a voice vote with one recorded nay and the motion carried.
The rezoning now awaits any further required readings or procedural steps for final adoption. Staff materials attached to the agenda were referenced during the staff presentation.
