The Cody City Council approved the Bluebird preliminary plat, advancing a 37-lot subdivision with infrastructure conditions and a cash-in-lieu payment.
Planning staff told the council the applicant (identified in the record as Harris Trucking and Construction) has decided to make alleys within the subdivision private rather than dedicating them to the City of Cody; the applicant will maintain those alleys. Staff also said the applicant is willing to pay a cash-in-lieu amount of $11,965.15 in place of dedicating land; that fee will be payable at the time of final plat.
Staff described an agreement in principle for the applicant and public works to upsize a storm/sanitary sewer pipe and to execute a cost-sharing arrangement to cover the improvements. Staff noted Lots 36 and 37 would be combined to site a sanitary lift station and a retention facility; staff clarified the lift station would be dedicated to the City of Cody and that the homeowners association would maintain the retention facility, consistent with previous subdivisions approved by the council.
A council member asked whether neighbors who had opposed a prior rezoning remained opposed to the current plat; staff said no one had come forward to discuss the plat at this stage and that notification occurs by agenda posting. After discussion, Council Member Shreve moved to approve the preliminary plat; Council Member MacIsaac seconded. The motion passed on a voice vote.
The council’s action advances the project to the final plat stage, at which point the cash-in-lieu payment and the final engineering and cost-sharing agreement will need to be finalized and recorded.
