CRA approves nondisturbance agreement for Meisner Park tenant

The Boca Raton Community Redevelopment Agency on Jan. 27 unanimously adopted Resolution 202502CRA, authorizing the executive director to execute a nondisturbance and related agreement with Meisner Park Cultural Arts Association, Inc. (MPCAA) and the George Snow Scholarship Fund, Inc.
Ruby Riley, downtown manager, told the board the CRA is the landowner and originally entered a civic site lease in 1992 that was later assigned to MPCAA in 2005. The George Snow Scholarship Fund is a tenant of the cultural center and has requested agency consent to a second amendment to its sublease that expands the subleased premises, extends the sublease term and increases the rent paid by George Snow. “Staff recommends approval of Resolution number 202502CRA as presented,” Riley said.
Board members asked why the nondisturbance agreement was needed now and whether prior nondisturbance agreements existed for other tenants. Riley said George Snow sought expanded cultural space and, to secure its possession irrespective of lease expiration or termination, requested a nondisturbance agreement; staff said it was not aware that other first-floor tenants have such agreements.
After opening and closing the public hearing with no speakers, a board member moved to adopt the resolution and another seconded. The clerk called the roll; the motion passed 5–0 with Wachter, Nacklis, Singer, Drucker and Thompson recorded as voting yes.
The resolution provides the agency’s consent to the sublease amendment and authorizes execution of the nondisturbance agreement subject to the terms, representations, warranties and covenants of MPCAA and George Snow contained in the amendment. No additional conditions or staff-directed follow-up were recorded during the meeting.
The CRA’s formal action finalizes consent for the sublease changes and the nondisturbance protection; the agreement’s effective date and any implementation steps will be handled by the executive director under the authority granted by the resolution.
