Boca Raton CRA approves nondisturbance, attornment agreement for George Snow Scholarship Fund at Meisner Park

The Boca Raton Community Redevelopment Agency on Jan. 27 voted unanimously to adopt Resolution No. 202502 CRA, authorizing the executive director to execute a nondisturbance and attornment agreement that clears the way for a sublease amendment between Meisner Park Cultural Arts Association, Inc. (MPCAA) and the George Snow Scholarship Fund, Inc.
The agreement, as described by Ruby Riley, downtown manager, gives the agency’s consent to a second amendment to the sublease that expands the size of the leased premises, extends the sublease term and increases the rent paid by George Snow. Riley told the board the agency holds a civic site lease dated Sept. 8, 1992, originally assigned to the International Museum of Cartoon Art and later assigned to MPCAA in March 2005.
"They needed to expand their space," Riley said, summarizing why the tenants requested the amendment and nondisturbance protections. She said the expanded use would fit the building’s cultural-space requirements and that MPCAA and George Snow represented in the amendment the conditions on which the agency's consent would rely.
Vice Chair Thompson asked why the item was before the board now given George Snow’s long tenure; Riley said the tenant had recently pursued options to expand and opted to secure nondisturbance protections as part of that process.
No members of the public spoke during the public hearing. Commissioner Wegder moved the resolution and Vice Chair Thompson seconded. Miss Sittins called the roll; the motion passed on a 5-0 vote.
The resolution authorizes the executive director to execute the nondisturbance and attornment agreement "subject to and in reliance upon the terms and conditions and the representations, warranties and covenants" provided by MPCAA and George Snow, according to staff remarks.
What happens next: staff will finalize the documentation for the executive director to sign and return to the board if any substantive changes occur before execution.
