Council adopts ordinance to exempt east-side A1A sidewalk requirement to protect dunes

The Boca Raton City Council on Jan. 28 adopted Ordinance No. 57-23, a city-initiated text amendment to Chapter 23 that exempts the installation or widening of sidewalks for development or redevelopment on the east side of State Road A1A north of Palmetto Park Road.
Mariela Overdorf, a planning intern with the Development Services Department, told the council the change is intended to "ensure the protection of environmentally sensitive land, dunes and dune vegetation" along that stretch of A1A and to align the code with existing comprehensive plan policies. She said the Planning & Zoning Board reviewed the item on Nov. 21, 2024, and recommended approval by a 4–1 vote.
Overdorf noted that the code currently requires 8-foot sidewalks on certain corridors, but staff confirmed that recent single-family approvals on A1A were treated under comprehensive-plan intent to protect dunes. "This text amendment clarifies and aligns with that intent," she said, and added that the amendment does not preclude future public or private installation of sidewalks subject to required permits. Overdorf also said the Florida Department of Transportation indicated its plans do not propose continuous sidewalks on both sides of A1A.
Council members asked whether the Beach Condo Association or east-of-A1A condo owners had submitted comments; staff said no feedback had been received. After a brief public hearing with no speakers in opposition, a council member moved to adopt the ordinance and Deputy Mayor Drucker seconded the motion. The clerk recorded votes for Wachter, Thompson, Singer, Nacklis and Drucker — all voting yes; the motion passed 5–0.
The ordinance amends the city code’s sidewalk policy to specify that installation or widening of sidewalks shall not be required for development or redevelopment of any property on the east side of State Road A1A north of Palmetto Park Road. Staff recommended adoption, citing environmental protections in the comprehensive plan and the Planning & Zoning Board’s recommendation.
The council did not record any immediate implementation actions beyond codification; staff said public agencies or private owners may still install sidewalks in the future if permitted.
