Cloud County approves filing of petition to open Trail Road; petitioner to cover all costs

At the Jan. 26 meeting the Cloud County Board of Commissioners approved filing a petition submitted by Ryan McMillan under KSA 68-117 to open Trail Road.
County attorney counsel Mike Montoya (by conference call) recommended the board approve the petition. Montoya told the commissioners the county would need to appoint road viewers and that McMillan would be responsible for all related expenses, including publications, bond costs, any required land purchases and road construction costs. The board approved the filing by unanimous vote on a motion by Commissioner Ron Copple, seconded by Commissioner Dannie Kearn.
The petition was filed under the statutory process identified in KSA 68-117 and the board recorded approval to proceed with petition filing; future steps noted in the record include appointment of road viewers and posting or publication steps required by statute.
