Levan council denies request to extend municipal water beyond town limits

Levan Town Council voted Feb. 12 to deny a petition requesting a consecutive connection that would supply municipal water to properties outside town limits.

Council members reviewed a developer proposal that offered to convey 18 acre-feet of groundwater to the town and included calculations estimating that amount could supply roughly 54 homes based on local consumption figures provided in the packet. Members raised liability and operational concerns: a consecutive connection would require the town to maintain distribution infrastructure, monitor water quality, and provide a certified operator for any distribution system. One council member said the arrangement looked beneficial on paper but carried long-term obligations the town had not previously accepted.

After discussion about easements, peak-flow impacts and whether the petition constituted an official application, a council member moved that Levan decline to provide municipal water outside town limits. “We will make a motion that we, deny the application and that, we do not provide water outside of town limits,” one council member said. Another member seconded the motion, and the council voted to deny the petition by voice vote.

The council’s action was framed as a general policy stance—members noted that approving one consecutive connection would set precedent for others and could carry maintenance and liability costs that outweigh the offered groundwater credit. Staff said details in the packet (market valuations and the developer’s calculations) will remain part of the record, and the town will not move forward with a consecutive connection absent further direction from the governing body.
