Committee sends e15 dispenser-fix to agriculture committee after questions about code process

Representative Harder presented House File 3651 to address a compatibility issue that prevents some dispensing equipment from offering E15 despite being safe for that blend. The bill would allow a station to meet fire-code requirements through a combination of a UL listing for E10 and a manufacturer certification that the equipment is compatible with E15.
Joe Sellwood of the Minnesota Ethanol Producers Association testified in support, saying federal EPA regulations and Minnesota Pollution Control Agency rules allow either a UL listing or written manufacturer statement to demonstrate E15 compatibility. Sellwood said UL testing and manufacturer warranties support using E10-listed dispensers to deliver E15 and cited Iowa's long experience allowing the practice as evidence.
Representative Johnson and others asked whether the fire marshal or normal administrative code processes might resolve the issue without legislation. State Fire Marshal Dan Cryer told the committee his office was actively exploring non-legislative alternatives and could have a resolution by the end of the week or early next week. Representative Harder and members agreed to work together as the bill moves to the Agriculture Finance & Policy Committee.
The committee recommended that House File 3651 be re-referred to the Agriculture Finance & Policy Committee by voice vote.
