Bill to create statewide pretrial data system sent to judiciary after cost and access questions

Representative Pinto presented House File 1775 (DE2), a bill directing the collection of statewide pretrial data to allow analysis of pretrial detention rates, geographic disparities and outcomes. Anna Hall of the Legal Rights Center and the Minnesota Justice Research Center described findings that pretrial detention affects plea decisions and that existing data live in disconnected systems with no easy way to analyze statewide patterns.

Pinto and the testifier said the immediate objective is to gather comprehensive data centrally; making detailed public reports would follow but the bill was revised to reduce near-term costs by allowing qualified research institutions to access the assembled data for analysis rather than requiring a government agency to publish static reports. Members asked how "research institution" would be defined, how the proposal interacts with judiciary data rules (including restrictions on public access to records of cases that do not result in convictions), and how cost savings would be realized; advocates said the change was intended to get data collection started with lower initial costs while protecting privacy and following judicial data rules.

Representative Novotny encouraged the sponsor to work with Ways and Means on funding options; Representative Pinto said stakeholders from across the political spectrum support the effort and the committee re-referred HF1775 to the Judiciary, Finance and Civil Law Committee for additional drafting and fiscal review.

Next steps: HF1775 was referred to judiciary; sponsors expect further committee stops and a fiscal note to be completed.
