Mark Cowley pressed the Meadow Planning and Zoning group on Dec. 9 to revise the town's subdivision ordinance so it aligns with state land-use code, arguing the town council should not serve as the land-use authority and that appeals must be structured as an independent appeals body.
"The ordinance said that the town council can be the land use authority and they can't do that," Mark said, urging that the planning and zoning body be designated to handle preliminary reviews while a separate administrator manage final actions. He cited several state code sections by number as the basis for his recommendation and noted that appeals can be taken to district court within statutory time limits.
Planning and Zoning participants discussed how the ordinance language should describe the administrator's powers and appointment process, and how the appeals group should be named and positioned to comply with state requirements. Jess responded that, if an application meets the ordinance requirements, a signature should not be able to stop an approval once both preliminary and final requirements are satisfied.
Members also flagged recordation language and timing requirements. Mark said he was concerned about a 30-day window to begin preliminary review; Andrew said the committee would meet as often as needed during that process. Andrew asked staff to double-check compatibility with the cited state code and to confirm whether the phrasing in section 10-4-1 ("The planning and Zoning shall be the land use authority") works with state law.
Mark asked that the ordinance include an amendment date. The Clerk said they would obtain the most up-to-date version of the ordinance and provide it to the town council; Andrew said he would make the recommended changes.
The Planning and Zoning group did not take a final vote on the ordinance language at the meeting; members directed staff to reconcile the draft with state code and to add the requested clarifications.
