Council delays enforcement finding for 1079 Western Avenue pending follow-up on pallets and tires

The Council laid over a decision on a summary abatement order for 1079 Western Avenue after the property owner said staff photos showed items that he was working to remove but that certain food-grade pallets are difficult to dispose of locally.
Legislative hearing officer Moorman outlined the original abatement order issued Nov. 12 with staggered deadlines for removal and said inspector photos from Jan. 5 showed pallets and tires still present. Property owner Miguel Neely told the Council he had tried to arrange pickup by the company that accepts the food-grade pallets but had not received a scheduled collection and asked for time to resolve the matter. Neely also said he had made improvements and asked that that be noted.
Councilmembers asked staff whether the city's bulky-item pick-up or contracted hauler could take the pallets and whether the owner had submitted photos of improvements as evidence; staff said the inspector's Jan. 5 photos are what the file shows and that the city would not pick up missing items if a crew was dispatched. Vice President Kim moved to lay the item over one week to Jan. 21 and to have staff work with the homeowner on disposal options; the Council approved the motion.
