The City Commission adopted Resolution 4215 clarifying collection authority for Tourism Business Improvement District No. 1, including an explicit option for the districts trustees to file liens for unpaid assessments.
City Manager Holly Phelps summarized work with the TBID board on unpaid assessment collection. City Attorney Tyler told the commission, "What this resolution lays out is that, the board of trustees does have the power to collect," and that the resolution "specifically... talks about the authority to... file a lien." Tyler also noted a scrivener's error in the agenda numbering and said the correct number appears on the draft before commissioners.
Commissioner Bueller moved to adopt Resolution 4215; Commissioner Roos seconded. Commissioners approved the resolution by roll-call vote.
The resolution clarifies available remedies for the TBID board under its bylaws and notifies trustees that nonpayment may lead to lien filing as an enforcement option. City staff also said planned bylaw changes for the TBID will follow and return to the board for consideration.
