The Waupaca County Board of Adjustment on July 29 approved formal hearing procedures and a timeline for the Conditional Use Permit appeal filed in connection with the Iola Old Car Show Inc. (Faulks Bros Construction Inc., applicant), setting an on-site inspection and deadlines for submissions ahead of a public hearing.
Chair A. Richardson presided over the meeting with Secretary J. Fulcher and board members P. Leder, M. Strebe and B. Abba present. Atty. Crystal Fieber, who presented the proposed procedure guidelines and Addendum A, told the board that Oct. 7, 2024 would be the deadline for Pre-Hearing Briefs, Witness and Exhibit Lists, and Written Comments.
Atty. Crystal Fieber said the schedule was intended to allow parties ample time to prepare and to permit written comments from members of the public who cannot attend in person. C. Bauer stated, "the on-site will occur Wednesday, October 16, 2024 at 8:30 a.m.; the Board is to meet at the Courthouse at 8:00 a.m."
During discussion, Atty. Christa Westerberg asked the board to hold an evening public hearing session to allow broader public participation; Atty. Mitch Olson opposed scheduling an evening session. Atty. Fieber responded that the Oct. 7 deadline allows people who cannot attend the daytime hearing to provide written comments in lieu of appearing.
The board decided to split the process so that the public hearing and the determination/deliberation occur in separate meetings. It agreed that the public hearing will begin Oct. 21, 2024 at 9:00 a.m.; the date for a separate meeting to make the final determination will be set later. Atty. Fieber also proposed switching the order of guidelines G and H to address public-participation concerns.
B. Abba moved to approve the procedures for the Conditional Use Permit appeal for Faulks Bros Construction Inc., with the amendment to switch the order of guidelines G and H; P. Leder seconded. The motion carried on a voice vote of 5 ayes and 0 nays.
The board’s action sets the timetable and logistics for the appeal process: Oct. 7, 2024 for pre-hearing filings; an on-site inspection on Oct. 16, 2024; a public hearing beginning Oct. 21, 2024 at 9:00 a.m.; and a later, separate session to deliberate and issue the determination.
